SUMMARY:Writing the Story of the Case
DESCRIPTION:Studies by law professors and articles by the likes of Richard Posner illustrate how persuasive stories are in affecting judicial decision-making and how underappreciated the storytelling art is among lawyers. \nGiving judges a reason\, on a human level\, to decide cases in your favor requires briefing grounded in law and logic coupled with a story that evokes an emotional response\, often on an unconscious level. Our typical story highlights people who encounter business misconduct\, fight against the stronger adversary while bucking long odds (the conflict that drives the story)\, and who should ultimately prevail if justice and fairness are honored (the climax and denouement). \nSkillful storytelling takes a brief from the law school writing course instruction of producing a “just the facts” soullessly objective piece of technical writing to the evocative ground of Atticus Finch moving the entire courtroom. Or at least it should. DESCRIPTION:The Federal Trade Commission (FTC) has finally done it. In 2010\, the Dodd-Frank Wall Street Reform and Consumer Protection Act granted the FTC the specific authority to write a rule tackling the unfair\, deceptive\, and abusive practices of motor vehicle dealers. This power lay dormant until now. The FTC recently announced a Notice of Proposed Rulemaking related to the sale\, financing\, and leasing of motor vehicles by dealers. \nThis webinar will cover the main points of the proposed rule\, including NACA’s and its consumer allies’ previously submitted petition to the FTC to rein in abusive yo-yo financing. There will be a discussion on how consumer advocates should respond to the agency’s proposed actions. A particular focus will be how to help your clients file their own stories as part of this rulemaking process. \nVehicle dealer fraud runs rampant. After working with the Legal Aid Justice Center for many years\, he joined Consumer Litigation Associates in 2016. A past board member of NACA\, he has worked on dealer fraud issues for over twenty-five years. \nErin Witte is the Director of Consumer Protection for Consumer Federation of America (CFA)\, where she advocates for consumer protections\, communicates policy positions\, and provides educational tools for consumers and CFA members about various consumer protection topics. Prior to joining CFA\, Erin was an Assistant Attorney General for the Commonwealth of Virginia\, where she litigated consumer protection cases in Virginia state and federal courts. Erin also worked in private practice at Surovell Isaacs & Levy in Fairfax\, VA\, where she represented individual consumer clients against used car dealers\, abusive debt collectors\, insurance companies\, predatory lenders\, subprime auto lenders\, and medical providers. \nChristine Hines is Legislative Director at the National Association of Consumer Advocates (NACA)\, where she advocates on consumer protection issues\, including financial services\, auto fraud\, and access to justice\, which covers the ongoing fight to end forced arbitration in consumer and worker contracts. Before joining NACA\, she was Consumer and Civil Justice Counsel at Public Citizen for seven years. Previously\, she practiced law briefly before moving into consumer protection policy advocacy.

As a visually impaired person since birth\, Jeffrey involves himself with assisting people with disabilities in all aspects of life and business. \nJosh Cohen started his legal career in October 2008\, when he passed the bar and founded his own firm. Through his law school experience\, he had worked for both legal aid and a private firm doing consumer protection work. Once on his own\, he continued with consumer protection but quickly began a niche in student loan work. With nine months of opening his firm\, he filed his first-class action against the student loan industry. He served in the White House for nearly seven years\, as Deputy Counsel to President Obama and Special Assistant to the President for Legislative Affairs. Chris oversaw the selection\, vetting\, and confirmation of more than 220 of the president’s judicial nominees—who set records for the most people of color\, women\, and openly gay and lesbian judges appointed by a president. He also was in charge of advising President Obama on commutations and pardons from 2014 to 2015 and helped spearhead the confirmations of Supreme Court Justices Sotomayor and Kagan\, the repeal of Don’t Ask Don’t Tell\, and passage of the Fair Sentencing Act. Chris also has served as National Director of the National Council of Asian Pacific Americans and worked for Senate Democratic Whip Richard Durbin as Director of Floor Operations and Judiciary Committee Counsel. In 2011\, the National Law Journal named him one of the top forty minority lawyers in the nation under the age of forty. Chris serves on the Board of Advisors of the American Constitution Society and the People’s Parity Project.

DESCRIPTION:The Federal Trade Commission’s core mission is to protect consumers from unfair and deceptive practices. This includes deceptive claims about how much money consumers can earn\, which crop up across a significant swath of the economy. SUMMARY:Navigating a State Practice Post-Ramirez
DESCRIPTION:In TransUnion v. Ramirez\, the Supreme Court’s ruling gave license to U.S. District Courts to systematically dismiss consumer claims for lack of Article III standing. Despite Congress’s creation of statutes that regulate businesses and provide statutory damages for those victimized by the illegal practices\, federal courts have now set higher standards on what is an injury that creates standing.
