SUMMARY:You Should Teach A Consumer Law Course
DESCRIPTION:In the wake of the great recession of 2008\, law schools saw a surge in interest in consumer protection courses\, covering issues such as mortgages\, debt collection\, and credit reporting. In the same way\, we anticipate that the COVID-19 pandemic and its economic fallout (job and housing loss\, predatory lending\, etc.) will lead to another swell in demand from law students for consumer protection-related courses. New crops of students will be interested in learning how they can help consumers in the context of their careers. \nIn order to prepare\, we anticipate that there will be a need for more instructors in law schools who are experts in these fields\, particularly and especially consumer advocates. \n\nWhat You Will Learn\n\nHow to find and approach a law school about teaching a consumer law course\nHow to organize a consumer law course\nHow to prepare to teach\, address students’ expectations\, and take advantage of your practical experiences in the field\n\n\nSpeakers\nLesley Fair has been  a distinguished lecturer on the adjunct faculty of the Catholic University Law School since 1984. She also teaches Consumer Protection Law at the George Washington University Law School and recently received GW’s Adjunct Faculty Teaching Award. After twenty-five years litigating false advertising and fraud cases\, she now specializes in consumer and business education. She is the primary author of the FTC’s Business Blog\, honored by the ABA Journal as one of the nation’s best law blogs and one of the few focusing on consumer protection issues. \nCary Flitter is founding partner in Flitter Milz P.C.\, based in Philadelphia. SUMMARY:The “Passive” Debt Buyer Issue
DESCRIPTION:If you are suing debt buyers under the FDCPA\, you need to understand the recent Circuit Court of Appeals decisions on whether these entities are debt collectors. This webinar is geared to intermediate practitioners. \n\nWhat You Will Learn\n\nWhere the Circuit Court of Appeals stands on the “passive” debt buyer issue\nWhat the ins and outs are of a debt buyer’s arguments that it is not a debt collector under the FDCPA\nHow to prove that a debt buyer’s primary purpose is debt collection\n\n\nSpeakers\nCorey D. McGaha is the founder of Corey D. McGaha PLLC\, a solo practice law firm in Little Rock\, AR. Mr. McGaha focuses his practice on debt defense\, FDCPA\, FCRA\, and Auto Fraud cases. SUMMARY:Background Screening CRAs: How to Effectively Conduct Discovery and Attack the Reasonableness of the CRAs’ Criminal Record Matching Procedures
DESCRIPTION:While more than 20 million U.S. jobs were wiped out in April 2020 during the COVID-19 lockdown\, the unemployment rate has begun to fall in recent months as the economy begins to reopen. This means millions of Americans will be applying for jobs and undergoing employment background checks. Employment and tenant screening CRAs routinely mismatch people\, omit crucial information about a case\, provide misleading information\, and misclassify offenses when preparing consumer reports in the form of employment and tenant screening background checks. Trying to apply for and gain employment during a global pandemic is tough enough\, and the last thing prospective employees need is inaccurate criminal record information showing up in their employment screening background check reports. \nIf you are litigating FCRA cases against some or all of the main players in the employment and tenant screening worlds\, you need to understand how to effectively conduct discovery to increase your settlement leverage\, prevail on your claims at summary judgement\, and ultimately win at trial. This webinar will provide an overview of the important information and documentation you need to request and obtain in discovery\, and it will provide practical advice on how to approach both written and deposition discovery for FCRA practitioners at the Intermediate level. \n\nWhat You Will Learn\n\nHow to identify the critical documents you need to prove your case\nWhat documents are ripe for motions to compel and when you should move to compel the production of certain critical documents\nHow taking depositions and asking the right questions can help you gain leverage and increase the overall value of your case\n\n\nSpeaker\nHans Lodge is senior counsel at Berger Montague\, leading the firm’s individual FCRA practice. Hans has litigated numerous individual and class cases throughout the country. Hans is a zealous advocate and is dedicated to protecting the rights of consumers in and out of court. Hans assists consumers who have been denied jobs or housing due to inaccurate criminal history information reporting in their employment and tenant screening background check reports. Hans also assists consumers who have been denied credit due to inaccurate information reporting in their credit reports. Hans is an aggressive and strategic litigator who has a reputation of working tirelessly to get favorable outcomes for his clients.

SUMMARY:What to Ask When You Don't Know: 30(b)(6) Depositions of Debt Buyers
DESCRIPTION:The deposition of a debt collector is critical to an FDCPA case. It is difficult\, if not impossible\, to survive summary judgment without it\, as most debt collectors refuse to provide any meaningful discovery otherwise. They also typically hide behind frivolous affirmative defenses and ludicrous denials of obvious truths. At best\, they just plead ignorance to everything. Testimony\, under oath\, by their corporate representative can be an excellent way to identify the difference between a shotgun defense/denial and one that requires more work to overcome. \nIf you find yourself fretting over an upcoming deposition\, or if you just want to refine your skills\, this webinar is for you. This webinar is appropriate for attorneys who are new to conducting depositions or who have intermediate experience. \n\nWhat You Will Learn\n\nHow to plan out and structure an effective 30(b)(6) deposition of a debt buyer\nHow to deal with a witness who provides evasive answers or wants to play “hide-the-ball”\nHow to find out the information you want to know\, but don’t know\n\n\nSpeakers\nCliff Carlson is a sole practitioner representing consumers in Texas\, Georgia\, and Alabama. His practice focuses primarily on consumer debt. He received his Juris Doctorate from the Mercer University Walter F. George School of Law in 2012. Cliff also received a Bachelor of Science in Electrical Engineering from Mercer University in 2005. He generally limits his practice to consumer rights issues\, such as Fair Debt Collection Practices Act and Fair Credit Reporting Act Violations. \nRonald “Ron” Daniels is also a 2012 graduate of the Walter F. George School of Law and has tried a variety of cases to verdict including an FDCPA jury trial in January of 2020. His practice focuses on representing consumers who are the victims of abusive debt collection practices or subjected to improper debt collection tactics by debt collectors and original creditors. He also serves as a Special Assistant Attorney general for the State of Georgia.
