SUMMARY:Deposing the Corporate Representative
DESCRIPTION:Are you tired of hearing “I don’t know” to every question you ask? Want to improve your questions\, or better yet\, improve your ability to obtain information from a reluctant witness? Would you like to know how to handle difficult\, obstructionist\, and unprepared witnesses? \nWhat You Will Learn\n• What strategies and techniques you can use to extract information from unwilling\, unprepared\, and uncooperative corporate representative deponent witnesses \n\nAbout Virtual Roundtables\nNACA is launching a new series of Virtual Roundtables\, each facilitated by a NACA member. These online sessions will consist of conversations to explore a specific topic. These sessions will not include a presentation and will depend on member participation. All attendees will be asked to provide feedback on the session afterwards. Attendance at Virtual Roundtables is capped at fifteen. Please register only if you plan on attending the live session. Unless noted otherwise\, the Virtual Roundtable will be recorded and available in NACA’s Training Library. \n\nFacilitator\nChris Donald began his practice of law after a first career working with UNIX and DEC operating systems and software development. His “sideline” work during that time\, and for the past three decades\, has been managing his family’s Alabama forestland for timber growth\, hunting\, and recreation. Boundary line issues encountered in this land work led him to pursue a law degree in mid-life\, taking classes at night and on the weekends\, where\, in keeping with the adage about the blind squirrel\, he somehow managed to graduate first in his class. During his time at law school\, he met and became instant friends with his future law partner\, Mike Parrish\, who teaches Commercial Law. After working on cases together for many years\, Chris formally joined forces with Mike as Parrish and Donald after which they started the firm of Alabama Car Lawyers LLC. Most of their practice is devoted to consumer law issues which usually involve lying\, cheating\, stealing\, and corporate greed in the sale\, warranty and repair of cars\, trucks and recreational vehicles. For the past two years\, Chris has taught Commercial Law as an adjunct professor at Birmingham School of Law. He is an avid outdoorsman\, fisherman\, and hunter\, and he enjoys backpacking\, biking\, and skiing with his sons and his wife Kristi.

SUMMARY:Deceptive Money-Making Opportunities
DESCRIPTION:The Federal Trade Commission’s core mission is to protect consumers from unfair and deceptive practices. This includes deceptive claims about how much money consumers can earn\, which crop up across a significant swath of the economy. NACA members may challenge deceptive earnings claims in their cases and may also repeatedly see the collateral effects that income scams have on the lives of their clients. In either case\, you may be interested to learn about the FTC’s work in this area\, including the recently announced Earnings Claim Rulemaking (comment period open until May 10). \nThe FTC has taken aggressive law enforcement action against coaching or mentoring schemes\, multi-level marketing companies\, work-from-home\, e-commerce\, and other business opportunity scams\, chain referral schemes involving cryptocurrency\, gig companies and employers\, job scams\, and businesses purporting to offer educational opportunities. In this webinar\, we’ll present information about the FTC’s work to combat misleading earnings claims\, with a focus on law enforcement and policy initiatives. \n\nWhat You Will Learn\n• What tools and legal theories the FTC uses to challenge earnings claims in different sectors\n• How certain types of deceptive earnings claims have a disproportionate effect on communities of color\n• What free resources the FTC offers to help consumers in every community avoid income scams\n• What the FTC’s Earnings Claim Rulemaking is and how can you make your voice heard \n\nSpeakers\nKati Daffan is an attorney and assistant director in the FTC’s Bureau of Consumer Protection in the Division of Marketing Practices. \nAndrew Hudson is an attorney in the same Division of the Bureau of Consumer Protection at the FTC. \nBoth Kati and Andrew work to combat fraud through civil law enforcement actions\, including against deceptive money-making schemes\, as well as policy initiatives such as the Earnings Claim Rulemaking.

SUMMARY:What's in Store in Federal Regulator’s Proposed Auto Fraud Regulation
DESCRIPTION:The Federal Trade Commission (FTC) has finally done it. In 2010\, the Dodd-Frank Wall Street Reform and Consumer Protection Act granted the FTC the specific authority to write a rule tackling the unfair\, deceptive\, and abusive practices of motor vehicle dealers. This power lay dormant until now. The FTC recently announced a Notice of Proposed Rulemaking related to the sale\, financing\, and leasing of motor vehicles by dealers. \nThis webinar will cover the main points of the proposed rule\, including NACA’s and its consumer allies’ previously submitted petition to the FTC to rein in abusive yo-yo financing. There will be a discussion on how consumer advocates should respond to the agency’s proposed actions. A particular focus will be how to help your clients file their own stories as part of this rulemaking process. \nVehicle dealer fraud runs rampant. If you’re a consumer advocate who has ever faced down dealers on behalf of defrauded and deceived consumers\, and if you would like better federal protections for your clients\, this is the webinar for you. \n\nWhat You Will Learn \n\nWhat policy changes the FTC is proposing to make in consumer-vehicle dealer sales\nWhat actions advocates and consumers can take in response to the proposed rule\n\n\nSpeakers \nTom Domonoske began practicing law in California in 1990 before moving to North Carolina where he taught classes at the UNC Law School. He then practiced as a legal aid lawyer with the Virginia Legal Aid Society\, Inc.\, from 1993 through 1996. From July 1996 through August 2000\, he was a Senior Lecturing Fellow at Duke Law School\, while also maintaining a small consumer law practice in Virginia as Of Counsel with the Law Office of Dale W. Pittman. In August 2000\, he returned to Virginia and continued focusing his practice on consumer law\, particularly the federal statutes that regulate financial transactions. After working with the Legal Aid Justice Center for many years\, he joined Consumer Litigation Associates in 2016. A past board member of NACA\, he has worked on dealer fraud issues for over twenty-five years. \nErin Witte is the Director of Consumer Protection for Consumer Federation of America (CFA)\, where she advocates for consumer protections\, communicates policy positions\, and provides educational tools for consumers and CFA members about various consumer protection topics. Prior to joining CFA\, Erin was an Assistant Attorney General for the Commonwealth of Virginia\, where she litigated consumer protection cases in Virginia state and federal courts. Erin also worked in private practice at Surovell Isaacs & Levy in Fairfax\, VA\, where she represented individual consumer clients against used car dealers\, abusive debt collectors\, insurance companies\, predatory lenders\, subprime auto lenders\, and medical providers. \nChristine Hines is Legislative Director at the National Association of Consumer Advocates (NACA)\, where she advocates on consumer protection issues\, including financial services\, auto fraud\, and access to justice\, which covers the ongoing fight to end forced arbitration in consumer and worker contracts. Before joining NACA\, she was Consumer and Civil Justice Counsel at Public Citizen for seven years. Previously\, she practiced law briefly before moving into consumer protection policy advocacy.

DESCRIPTION:There has been a significant increase in collection lawsuits filed against family members and loved ones to collect on nursing home residents’ debts. In this webinar\, you will learn the basics of nursing home collection lawsuits and how to effectively defend these abusive actions against third parties and residents. No prior experience with or knowledge of nursing homes or long-term care is needed. \n\nWhat You Will Learn: \n\nWhat common claims are brought by nursing homes against residents and third parties\nWhat affirmative defenses and counterclaims to bring in nursing home collection cases\nHow to resolve these cases quickly through motion practice\n\n\nSpeaker \nAnna Anderson is a Supervising Attorney at Legal Assistance of Western New York (LawNY)\, where she oversees the Consumer and Economic Justice Unit\, serving fourteen counties in Western New York. Anna is admitted to the New York State Bar\, Fourth Department (2016)\, and the United States District Court\, Western District of New York (2019). She is the co-founder and chair of the National Coalition of Nursing Home Debt Advocates.

SUMMARY:Writing the Story of the Case
DESCRIPTION:Studies by law professors and articles by the likes of Richard Posner illustrate how persuasive stories are in affecting judicial decision-making and how underappreciated the storytelling art is among lawyers. \nGiving judges a reason\, on a human level\, to decide cases in your favor requires briefing grounded in law and logic coupled with a story that evokes an emotional response\, often on an unconscious level. Our typical story highlights people who encounter business misconduct\, fight against the stronger adversary while bucking long odds (the conflict that drives the story)\, and who should ultimately prevail if justice and fairness are honored (the climax and denouement). \nSkillful storytelling takes a brief from the law school writing course instruction of producing a “just the facts” soullessly objective piece of technical writing to the evocative ground of Atticus Finch moving the entire courtroom. Or at least it should. This webinar is geared to attorneys of all experience levels. \n\nWhat You Will Learn\n• How to marry the elements of plot and theme to create a coherent and persuasive legal argument\n• How to use deep frames to subtly convey ideas in text and subtext\n• How to distill and recapitulate to reinforce the message of plot and theme \n\nSpeaker\nJohn Roddy represents consumers in class actions challenging unfair and deceptive business practices and serves as relator’s counsel in qui tam “whistleblower” actions. In the last two decades\, the settlements in cases he has litigated have returned more than $1 billion to consumers harmed by marketplace misconduct. John regularly writes and speaks on class action practice and consumer financial services law\, and he has published dozens of articles on these topics. He has co-chaired Practicing Law Institute (PLI)’s Annual Consumer Financial Services Institute for the past twenty-five years. John is also a Fellow of the American College of Consumer Financial Services Lawyers\, an organization limited to those lawyers who have achieved preeminence in the field of consumer financial services law and who have made repeated and substantial contributions to the promotion of learning and scholarship in consumer financial services law through teaching\, lecturing\, and published writings.

SUMMARY:FCRA 101 eCourse
DESCRIPTION:Nonmembers need to be verified. Email us to start the process.\n\n\n\nAccording to the Federal Trade Commission\, approximately 20 percent of Americans have serious mistakes on their credit reports. This impacts their abilities to purchase homes and cars and even to secure jobs. With many Americans currently and projected to be struggling to make ends meet\, the need to access credit is crucial to allow families to stay in their homes and avoid car repossessions. Incorrect credit reporting makes home and car loans unaffordable to those most vulnerable. The Fair Credit Reporting Act (FCRA) delineates consumer rights regarding reporting of consumer data and responsibilities of Credit Reporting Agencies (CRAs) and furnishers to provide accurate information. \n\nAbout the eCourse\nThe FCRA eCourse is a self-paced primer for attorneys interested in adding FCRA cases to their practice. The goal of the course is to prepare beginner and intermediate practitioners to litigate an FCRA case from the ground up. The eCourse includes information about claims and issue spotting\, navigating the dispute process\, and litigating through settlement and summary judgment. It contains an interactive story\, fifteen webinars\, and key sample documents including complaints and discovery requests. \nParticipants will receive a certificate of completion upon completion of each component of the course\, up to 17 CLE credits. In order to receive the certificate\, you must complete the course. SUMMARY:Spotting FCRA Violations by Reviewing Your Client's Credit Reports
DESCRIPTION:he national credit bureaus maintain credit files for most consumers and issue credit reports to third parties based upon the contents of these files.  That information includes data about credit and collections accounts supposedly associated with a particular consumer\, such as the balances over time\, payment history\, and credit usage.  Consumers have important rights and powerful remedies under the Fair Credit Reporting Act (FCRA) regarding the accuracy of the information published in their credit reports. \nIn this webinar\, you will begin to learn how to spot certain common FCRA violations on your clients’ credit reports.  These skills can be applied beyond credit reports from the Big Three (Equifax\, Experian\, and TransUnion) to other types of “consumer reports” issued by the many specialty consumer reporting agencies relating to a variety of industries such as tenant screening\, employment background checks\, insurance\, banking\, and more. This webinar is geared to beginners\, no prior experience is needed. \n\nWhat You Will Learn \n\nWhat are the common causes of credit report inaccuracies\nWhere to look for inaccuracies on a credit report\nWhat is the importance of pursuing claims based only upon objective inaccuracies (as opposed to claims embodying a legal dispute)\n\n\nSpeaker \nAs founder of the Law Office of Adam G. Singer\, PLLC\, Adam has focused his practice on helping consumers enforce their Fair Credit rights.  Most frequently\, Adam’s cases involve the defamatory fallout from negative credit reporting that arises from identity theft or mixed files.   Adam earned a B.A.\, summa cum laude at Washington University and a J.D.\, cum laude at the University of Pennsylvania Law School.  Adam began his legal career as a law clerk to the Hon. Sidney H. Stein\, U.S.D.J. in the S.D.N.Y. and as an associate at the law firms of Skadden Arps and Akin Gump before starting his own consumer practice. \n
