NACA joined an amicus effort to support the plaintiffs, Commissioners for the Consumer Product Safety Commission who had been terminated without cause prior to the expiration of their terms, in their lawsuit against the government seeking reinstatement to their positions. The federal district court sided with the plaintiffs and held that the plaintiffs’ termination was unlawful and that they must be permitted to return to work. The amicus brief argues that the 4th Circuit should affirm the lower court’s ruling and find that Commissioners of the CPSC can only be removed for cause. The brief goes on to argue that this protection allows for greater independence within the CPSC by maximizing the ability for the agency to do its job to protect consumers without political oversight.
