NACA signed onto an amicus effort in the D.C. Court of Appeals to support the Appellants in their efforts to overturn a 2009 decision that granted immunity to utility companies against potential claims by consumers arising under the D.C. Consumer Protection Procedures Act for unfair and deceptive trade practices.  The brief argues against the fundamental unfairness that the judicially-created immunity creates by preventing consumers from addressing the widespread problems that they face when dealing with utility companies.  The brief goes on to list the multitude of issues that consumers must confront with no recourse because of the immunity provided to utility companies under the CPPA and argues in support of overturning the prior decision to allow consumers to bring claims against their utility companies.
