NACA filed an amicus brief in the Ohio Supreme Court to support a consumer’s argument that a trial court’s decision to grant a motion to compel arbitration should be immediately appealable.  The appellate court denied the appeal based on the Federal Arbitration Act’s restriction on immediate appealability of a decision to compel arbitration despite an Ohio statute allowing appeals in that scenario.  Raising questions of preemption and federalism, the consumer is asking that the Ohio Supreme Court recognize the applicability of the Ohio statute over the FAA.
