NACA joined an amicus effort in the New York Court of Appeals to support the plaintiff’s effort to reverse the lower appellate court’s decision to adopt the Supreme Court of the United States’ standing requirements in TransUnion v. Ramirez for a claim under the FDCPA in New York state courts. After the Ramirez decision, many consumers chose to bring claims under consumer protection laws in state court, where federal Article III standing requirements are not applicable. However, after the lower appellate court decided to apply Ramirez to state court actions, it would prevent many New York consumers from accessing the courts utilizing standing requirements that had been long established under New York law.
