NACA v. General Motors Financial, D.C. Superior Court, Case No. 2026-CAB-003388

What this case is about: NACA, as both plaintiff and co-counsel, filed a lawsuit arguing that GM Financial, a wholly owned captive finance subsidiary of General Motors and one of the largest auto finance companies in the country, is improperly charging fees to borrowers who make their auto loan payments online or over the phone.  These fees, known as “pay-to-pay fees,” are not expressly authorized by the terms of GM Financial’s standard loan agreements and greatly exceed the costs to GM Financial of processing a consumer’s electronic and telephonic payments.  The complaint goes on to allege that GM Financial, by unlawfully charging these “pay-to-pay fees,” is violating the District of Columbia’s Consumer Protection Procedures Act.
