NACA submitted an amicus brief asking the Ninth Circuit Court of Appeals to reverse the District Court’s granting of summary judgment in favor of the defendant and dismissal of the plaintiff’s lawsuit seeking damages for Nationstar Mortgage’s unlawful charging of junk fees in violation of the FDCPA. In the underlying case, the plaintiff challenged Nationstar Mortgage’s use of a fee for a customer to receive a payoff statement. The plaintiff argues that the District Court erred by finding that the fee was permitted because it was not expressly prohibited by law and ignoring the application of the FDCPA to prohibit the charging of this fee.
